Terms of Service
Last updated: 13 October 2026
In short: this page covers use of our website. When you hire us, the proposal, statement of work and agreement we sign with you set the detailed terms for your project, and they take priority over this page if the two differ.
1. About these terms
These terms apply when you use blackjokeralien.com or contact us about our services. The website is operated by BlackJoker Alien Technologies ("BJAT", "we", "us"), an MSME-registered business based in Noida, Uttar Pradesh, India. By using the website you agree to these terms. If you do not agree, please do not use it.
2. Our services and separate agreements
We offer website and mobile app development, AI integration and chatbots, custom software, digital marketing, 1-on-1 AI coaching and job-ready IT training. Information on this website describes our services in general. Each engagement is defined by a written proposal, statement of work, enrolment form or booking confirmation, and a signed agreement where appropriate.
Quotes are valid for the period stated in the quote. A project begins only when both sides have agreed the scope in writing and any advance payment has been received.
3. Using the website
- Use the website only for lawful purposes and in a way that does not damage it or interfere with others.
- Do not try to gain unauthorised access, scan for vulnerabilities without our written permission, or send spam or malicious code through our forms.
- Give accurate information when you contact us.
4. Intellectual property
The website, including its text, design, logos and code, belongs to BJAT or its licensors and is protected by law. You may view it and share links to it, but you may not copy it for commercial use without our written permission.
Client deliverables. Unless your agreement says otherwise, once we have received full payment for a project, ownership of the custom source code and design files we created for you transfers to you. We keep ownership of our pre-existing tools, templates and general know-how. Third-party libraries, fonts, stock assets and services remain under their own licences. We may show non-confidential parts of completed work in our portfolio only with your permission.
5. Fees, payment and taxes
Fees are stated in the proposal or booking confirmation, in Indian rupees or US dollars as agreed. Unless stated otherwise, amounts exclude applicable taxes such as GST and any bank or payment-provider charges. Work is invoiced in the milestones set out in the proposal. Our Refund and Cancellation Policy explains what can be refunded.
6. Your responsibilities
- Provide the content, access and feedback we need, on time.
- Make sure you have the right to use any material you give us, such as images, text, logos and data.
- Keep your own accounts and credentials safe, and use official sign-in or connector flows rather than sharing passwords with us. Remove our access when the work ends.
- Make sure your use of what we deliver complies with the laws that apply to your business, including advertising, consumer and data protection rules.
7. Coaching and training
Coaching and training are educational. We do not guarantee any particular outcome, including a job, a promotion, income or time saved, because results depend on your effort and circumstances. Sessions are recorded only with your agreement. Please treat other participants and our team respectfully. We may end a session or program for abusive or unlawful conduct, and the refund position is then as set out in our Refund and Cancellation Policy.
8. AI-assisted work and third-party tools
We may use AI tools to assist with drafting and development, and our people review the results. AI can still make mistakes, so please check outputs that matter to you. The tools we use or connect for you, such as Claude, ChatGPT, Gemini, WhatsApp, Google Workspace and payment gateways, are provided by other companies and are governed by their own terms. See our AI Usage Policy.
9. Confidentiality
We treat non-public information you share with us as confidential, use it only to provide the services and share it only with people and providers who need it and are bound to protect it. We are happy to sign a mutual non-disclosure agreement before you share sensitive material. This does not cover information that is already public, that you have told us we may share, or that we must disclose by law.
10. Warranty and disclaimers
We perform our services with reasonable skill and care. The length and scope of any post-launch warranty for fixing defects are stated in your agreement. Apart from that, and to the extent the law allows, the website and our general information are provided "as is", without promises that they will be uninterrupted or error-free. Nothing here limits rights you have under law that cannot be excluded. See also our Disclaimer.
11. Limit of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business opportunities. Our total liability for any claim connected with a service is limited to the fees you paid us for that service in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
12. Ending an engagement
Either side may end an engagement as set out in the agreement or proposal. Our projects have no lock-in period. If an engagement ends, you pay for work completed and approved costs incurred up to that point, and we hand over the work completed and paid for.
13. Governing law and disputes
These terms are governed by the laws of India. If a dispute arises, we will first try to resolve it through good-faith discussion for at least 30 days. If that does not work, the courts at Gautam Buddh Nagar (Noida), Uttar Pradesh, India have jurisdiction, unless your signed agreement says otherwise. If you are a consumer outside India, this does not remove any mandatory rights you have under the law of your own country.
14. Changes
We may update these terms from time to time. The date at the top shows the latest version. If you continue to use the website after an update, you accept the updated terms. Existing signed agreements are not changed by updates to this page.
